James Luo Appointed as Expert of Supreme Court IP Case Law Cente​r


Dr. James Luo, managing partner of Lawjay Partners, had recently been appointed as a legal expert of the Expert Advisers Committee of the Supreme People’s Court’s IP Case Law Center.      

James is among the most influential figures in China’s IP practice and had been instrumental in countless legal reforms in China’s IP regime. During the recent amendment of the Trademark Law, he was sought to provide comments on its corresponding Implementing Regulations, TRAB rules and judicial interpretations.

With his recent appointment, James, who is an established legal authority in IP litigation and enforcement with over 20 years' experience, will be sitting in said committee composed of China’s highly-esteemed IP experts, among them being Dr. LIU Chuntian, dean of the IP School of Law of the prestigious Renmin University of China and Dr. WU Handong, former president of Zhongnan University of Economics and Law. Formed in May 2016, the Expert Advisers Committee is an important organ of the SPC's IP Case Law Center, having the role of analyzing and evaluating model cases and providing said Center advice and guidance on IP cases. The Committee is further subdivided into four groups: a trademark group, a patent group, a copyright group and a multi-disciplinary group. The SPC established the IP Case Law Center in April 2015 in order to initiate and evolve a judicial precedent system, set judicial standards, and develop a case guidance system appropriate for China. To date, the IP Case Law Center had formulated a mechanism for the issuance of guiding cases and had developed a diversified case guidance system and a specialized consulting system.

Throughout his legal career, James had been highly active in the legal community and industry organizations, vigilantly advocating the advancement of trademark law and promoting awareness of IP rights. He served as Chairperson of the Trademark Committee of the Beijing Bar Association from 2012 to 2015. For his outstanding performance, he was recognized as an Outstanding Committee Director, while the Trademark Committee he chaired was recognized as an Outstanding Committee. James had likewise served as Chairperson of the China Sub-Committee of INTA’s Anti-Counterfeiting Committee, INTA, and Vice Chairperson of the Quality Brands Protection Committee. Due to his remarkable achievements, in 2013, James was recognized by the Beijing Bar Association as among the Top 10 IP Lawyers in Beijing.

James is consistently ranked by Legalband as a band-one leading individual in IP litigation, and is recognized as among China's leading IP lawyers by Chambers and Partners, World Trademark Review, Who's Who Legal, MIP and Asialaw, among others. James earned his PhD in IP at Renmin University and his LLM in IP at King's College London, and was a visiting researcher at the Franklin Pierce Law Center. He is a guest professor at renowned law schools and frequently speaks at domestic and international conferences.

Every year, James represents various top luxury brands and world-famous marks in over a hundred civil and criminal lawsuits for trademark and copyright infringement.
